User Agreement
This User Agreement ("Agreement") governs the use of Bachar Samawi Innovations (“BSI”), ("Service Provider"), or anyone else designated by BSI as Service Provider, and its web sites, www.smilerise.org , www.smilerise.net , www.smilerisepoem.com and/or www.BacharSamawiInnovations.com ("Service"). In the case where the Service redirects user to a regional service affiliated with BSI offering services in a specific country , Service Provider shall be redefined as stated in such user agreement.
You must read this Agreement and its Rules in its entirety prior to using the service or making any purchase/contribution/donation. Your use of the Service will constitute your agreement to comply with these Rules. If you cannot agree with these Rules, you should not use the Service. These Rules may be modified by the Service Provider at any time. Any modifications will be posted on this page. Your continued access of the Service will constitute your acceptance of any modifications to the Agreement.
Service Provider may terminate access to Service, without notice, to anyone who violates Rules.
If you fail to follow these Rules, or any additional rules posted anywhere by the Service, Service Provider may terminate your access to Service. In addition Service Provider may also seek other remedies, including and not limited to compensation for any financial damages. Furthermore, in case of breach of these Rules, we will also seek maximum penalties allowable by law.
RULES
The Service Provider tries to do all it can to be accurate in the content of information on its Service, Service Provider will not be held liable or responsible for any omissions or mistakes contained in provided information.
You acknowledge that the Service Provider and its affiliates have not reviewed the content of all sites linked to from the Service and are not responsible for the content or actions of any other sites linked to from this Service, including payment processor(s) (“Payment Processor”) such as Paypal (our current payment processor), Square, or another current or future payment processor, and do not endorse them. Your linking (whether automatic or deliberate) to any such service or site is at your own risk.
You acknowledge that Service Provider is not responsible for the actions of Payment Processor such as Paypal or Square. Paypal is also the preferred payment processor for Ebay.There are over 250 Million users of Paypal, and it's accepted by merchants everywhere. There are over 20 Million Square users.
You also acknowledge that Service Provider and its affiliates are not responsible for any damages, financial or non financial, arising from the use of Paypal, Square or Payment Processor for the processing of your purchase order, or any other use whatsoever.
INDEMNIFICATION
You agree to indemnify the Service Provider and its affiliates, employees, agents and representatives, and to hold them harmless, from any and all claims and liabilities (including attorneys fees) which may arise from your use of material(s) obtained through the Service, or from your breach of this Agreement, or from any such acts through your use of the Service.
DISCLAIMER OF WARRANTY AND LIMITATION OF LIABILITY
You acknowledge that you are using the service at your own risk. The service is provided "as is", and the service provider and its affiliates hereby expressly disclaim any and all warranties, express and implied, including but not limited to any warranties of accuracy, reliability, title, merchantability, non-infringement, fitness for a particular purpose or any other warranty, condition, guarantee or representation, whether oral, in writing or in electronic form, including but not limited to the accuracy or completeness of any information contained therein or provided by the Service.
While the Service Provider is doing all it can to provide an enjoyable electronic experience, it, and its affiliates, do not represent or warrant that access to the Service will be uninterrupted or that there will be no failures, errors or omissions or loss of transmitted information, or that no viruses will be transmitted on the Service.
The Service provider and its affiliates shall not be liable to you or any third parties for any direct, indirect, special, consequential or punitive damages allegedly sustained arising out of your access to or inability to access the Service (and its products and reports), including for viruses alleged to have been obtained from the Service, your use of reliance on the Service or any of the information or materials available on the Service, regardless of the type of claim or the nature of the cause of action, even if advised of the possibility of such damages.
JURISDICTION
You agree that this Agreement, for all purposes, shall be governed and construed in accordance with the laws of Vermont, U.S.A. applicable to contracts to be wholly performed therein, and any action based on or alleging a breach of this Agreement must be brought in a court in Vermont, U.S.A.. In addition, you agree to submit to the personal jurisdiction and venue of such courts.
In the case where the Service redirects user to a regional service offering services in a specific country, Jurisdiction shall be as stated in the user agreement of such service to which user is redirected, and where service provider shall be as stated in such user agreement.
PRIVACY POLICY
The Service Provider respects your privacy and seeks to protect your personal data. It collects and uses your information to administer, support, improve and obtain feedback on our services and to detect and prevent faults, breaches of our network security, the law or our contract terms. We will also use all this information to personalize our services and marketing. If you have purchased any of our products or reports we may contact you to obtain feedback on our services and for any improvements we could make to it.
The results of any opinion polls or research we may conduct, and you may participate in, may be made available to the public. In general, in such opinion polls and research, your submitted information becomes part of the total poll statistics to be published, and you agree to the publishing of such data containing your responses. In such polls and research, the identity of those providing the responses is kept private and confidential.

FURTHER INFORMATION & MARKETING
The Service Provider may contact you about its services. We may, for example invite you to receive a free trial report or ask your opinion about quality of our reports and website in general. Such contact may be by email from time to time.
INFORMATION YOU GIVE US
This information includes, and may not be limited to, your first name, last name, address, name of the company (optional), profession/occupation (optional), e-mail, telephone/fax contact numbers, products you purchased or inquired about.
Payment Information:
PayPal and/or Square are the payment processor for Service Provider at this time, but a different payment processor may be appointed in the future.
Using Paypal, you can either pay through your existing account with Paypal, or by submitting to Paypal other payment options such as credit card information. At this time, using Square, you can submit payment options such as credit card information; Square may provide additional options.
Service Provider does not retain any of the payment information, as such information is submitted directly to Paypal, Square or other payment processor.
Service Provider is not responsible for the conduct of Paypal, Square or other payment processor.
Subscribers’ use of Paypal, Square or other payment processor is at their own risk.
We are not a Non-Profit organization or entity. To our best knowledge, any payments, contributions and/or donations made to us are not tax-deductible as charitable donation, because we are not registered as a section 501(c)(3) charitable organization. We are a Limited Liability Company.
INFORMATION WE COLLECT VIA OUR SERVICES
We may also gather information about your use of our services, such as generic types of data accessed, times and volume of use of the services and Traffic Data. Traffic Data includes logs, details of networks, data and systems accessed, details of the sender and recipients of messages sent over our services, times and location of log on or access, duration of sessions, click stream and similar usage or system data.
STORAGE METHODS AND DURATION
The Service Provider and its affiliates may store your information in its databases. The information may be retained and used by the Service Provider and its affiliates for a reasonable period, reflecting our need to answer queries or resolve problems, provide improved and new services and any data retention requirements of the law. This means we may retain information after an individual ceases to use services or after the individual has ceased interacting with us. Except where the law, authorities or regulatory bodies require us to retain it for longer, we retain Traffic Data for a reasonable period after the Traffic Data was generated, including in some circumstances (such as with firewall logs or fault data) after any bill has been paid.
PASSING YOUR INFORMATION TO THIRD PARTIES
As a general policy, the Service Provider and its affiliates do NOT sell, rent or share your personal data to others other than with our affiliates and strategic partners. If we sell a business division to another company and your personal data is used by that business then your data may be transferred to the buyer along with the business, for them to use only in the same way.
ADVERTISING ON OUR WEB SITE
Where advertising is served on to our web site there may be cookies used to collect technical information and generic usage information but third party advertisers are not allowed to relate this to you as an individual without your consent.
INTERCEPTION OF MAIL
The Service Provider and its affiliates may intercept some mail and email addressed to individuals of Service Provider. The reasons it may do this are related to security of the Service Provider, its staff and others, for detection and prevention of crime and to identify correct recipients or to make sure mail is dealt with during staff absence. In the case of emails, we may reject, delay or remove content from emails which have a nature, content or attachments which may disrupt our systems or because they may pose security issues such as viruses. We may also filter out emails that contain certain content on the basis that content is offensive or the email is unwanted or Spam. In certain circumstances this may unfortunately result in "innocent" emails being affected but we do try and reduce such occurrences.
SECURITY AND STAFF AWARENESS
The Service Provider and its affiliates have developed strict corporate policies governing information technology. These cover areas such as access control, authentication, audit, monitoring, alarms, data storage and back up and transmission standards and environment integrity. Staff members and contractors are subject to a code of conduct that requires them to adhere to privacy principles.

ENTIRE AGREEMENT
This Agreement is the complete and entire agreement between the parties and supersedes any prior agreement, whether written or oral. If you don't agree to the terms contained in this Agreement, please exit the Service.
